3. In the Matter of Alicia Cruz 4 School Board 2016 and Alicia Cruz; FPPC No. 17/620. Staff: Commission Counsel Theresa Gilbertson and Supervising Special Investigator Jay Martin. Alicia Cruz was a successful candidate for the Washington Unified School District Board of Education in the November 8, 2016 General Election. Alicia Cruz 4 School Board 2016 was her candidate-controlled committee. The Committee and Cruz failed to establish a dedicated campaign bank account to make all campaign expenditures from and deposit all contributions into, in violation of Government Code Section 85201 (1 count). The Committee also failed to timely file one pre-election and one semiannual campaign statement covering the reporting periods of January 1, 2016 through December 31, 2016, in violation of Government Code Sections 84200, 84200.5, and 84200.8 (1 count). Total Proposed Penalty: $3,500.

Quality Education in Support of Recall Lorona, Orosco, Lopez was a committee primarily formed to support a recall of three Selma Unified School District Board members on the November 3, 2015 General Election ballot in Fresno County. Sara Rodriguez was the Committee’s treasurer. Harpreet Purewal, Frank Hoyt, and John Hoyt were the Committee’s principal officers. The Committee, Rodriguez, Purewal, and the Hoyts accepted cash contributions of $100 or more, in violation of Government Code Section 84300 (1 count); and failed to timely disclose the receipt of nonmonetary contributions, in violation of Government Code Section 84211 (1 count). Total Proposed Penalty: $4,000.

Yes on Prop. 57, Californians and Governor Brown for Public Safety and Rehabilitation was a primarily formed ballot measure committee created to support California Proposition 57 on the November 8, 2016 General Election ballot. The Committee failed to identify the California Democratic Party as one of its top two contributors of $50,000 or more, and failed to present the text in a clear and conspicuous manner in an advertisement disclosure statement on its website, in violation of Government Code Section 84503 and Regulation 18450.4, subdivisions (b)(1) and (b)(3)(G)(1) (1 count). Total Proposed Penalty: $2,500.

6. In the Matter of Los Angeles County Metropolitan Transportation Authority; FPPC No. 16/469. Staff: Commission Counsel Ruth Yang. The respondent was represented by Assistant County Counsel Charles Safer. The Los Angeles County Metropolitan Transportation Authority (“LA Metro”) is a public transportation agency for the County of Los Angeles. LA Metro failed to accurately report the payments made to lobbying firms, in violation of Government Code Section 86116, subdivision (b), (1 count); and failed to timely disclose other payments to influence, in violation of Government Code Section 86116, subdivision (h)(1) and 86117 (1 count). Total Proposed Penalty: $3,500.

7. In the Matter of Riverside County Office of Education; FPPC No. 18/101. Staff: Commission Counsel Ruth Yang and Special Investigator Garrett Micheels. The respondents are represented by John W. Dietrich of Atkinson, Andelson, Loya, Ruud and Romo. In or around January 2018, the Riverside County Office of Education designed, printed, and distributed over 200 copies of a booklet at public expense featuring photographs and names of several elected officials, in violation of Government Code Sections 89001 and 89002, subdivision (a) (1 count). Total Proposed Penalty: $2,000.

Privacy for All Students is a primarily formed ballot measure committee created to support several attempts to qualify a ballot measure that would undo Assembly Bill 1266, which permits student participation based on gender identity. John Fugatt is the Committee’s treasurer. Karen England is the Committee’s principal officer. The Committee, England, and Fugatt failed to timely file four semiannual campaign statements covering the reporting periods of October 1, 2013 through December 31, 2013, July 1, 2014 through December 31, 2015, and January 1, 2016 through December 31, 2016, in violation of Government Code Section 84200, subdivision (a) (1 count); and failed to timely report contributions on a quarterly campaign statement; contributions, expenditures, and a miscellaneous increase to cash on a semiannual campaign statement; and contributions on a semiannual campaign statement, in violation of Section 84211, subdivisions (a), (b), (c), (f), (i), (k), and (l) (1 count). Total Proposed Penalty: $6,500.

Total Proposed Penalty: $3,500.

13. In the Matter of Ramirez for Senate 2013, Francisco Ramirez for Hanford City Council 2014, and Francisco Ramirez; FPPC No. 15/1277 (Streamline Settlement). Staff:  Commission Counsel Michael W. Francisco Ramirez was an unsuccessful candidate for State Senate District 16 in the May 21, 2013 Primary Election and a successful candidate for Hanford City Council in the November 4, 2014 General Election. Ramirez for Senate 2013 was the candidate-controlled committee in the 2013 Primary Election. The Senate Committee and Ramirez failed to timely file one semiannual campaign statement covering the reporting period of May 5, 2013 through June 30, 2013, in violation of Government Code Section 84200 (1 count). Francisco Ramirez for Hanford City Council 2014 was the candidate-controlled committee in the 2014 General Election. The City Council Committee and Ramirez failed to timely file a Statement of Organization, in violation of Government Code Section 84101 (1 count); two pre-election campaign statements covering the reporting periods of January 1, 2014 through October 18, 2014, in violation of Government Code Sections 84200.5 and 84200.7 (2 counts); and one semiannual campaign statement covering the reporting period of October 19, 2014 through December 31, 2014, in violation of Government Code Section 84200 (1 count). Regulation 18700.2 is being amended to better clarify when an official’s interest in a business entity is also an interest in that business entity’s parent, subsidiary or otherwise related business entity for purposes of the Act’s conflicts of interest provisions. The amendments also propose an exception to when an official has an interest in a parent or subsidiary of a business entity when the subsidiary has not been listed on reports filed by the parent corporation with the SEC or on an annual report and the official has stock ownership below a certain threshold.
