FPPC Enforcement Decisions: April 2001

The following is a summary of decisions by the Fair Political Practices Commission made at the regular monthly meeting of the FPPC on April 6, 2001, in Sacramento. Decisions are divided by category and include brief summaries of each case and the amount of the fine. Further information on each enforcement case can be found in the stipulations agreed to by the commission and by the individuals and organizations subject to the fines. Also attached for your information is a recent staff memorandum describing the Major Donor Program for streamlined prosecution of major-donor violations. The streamlined program was initiated last December. FPPC agendas are mailed and posted on the agency web site at www.fppc.ca.gov 10 days prior to each monthly meeting. COMMISSION MEETING OF APRIL 6, 2001 - ENFORCEMENT ACTIONS Concealing True Source of Campaign Contributions Ricardo Ramirez, FPPC No. 97/654. (Index No. 70421.) Respondent, a San Francisco businessman, made four $500 campaign contributions to San Francisco mayoral candidate Willie Brown in the names of other persons, in violation of Government Code sections 84301 and 84300 (4 counts). $6,000 fine. Failure To Timely File Lobbyist Employer Report and Failure To Maintain Records Traditional Values Coalition and Rev. Louis P. Sheldon, FPPC No. 99/84. (Index No. 70425.) Respondent Traditional Values Coalition of Anaheim failed to timely file a Report of Lobbyist Employer, in violation of Government Code section 86115, and failed to maintain records for the same reporting period, in violation of section 86110. Respondent Louis Sheldon failed to complete a Lobbyist Report for the same reporting period, in violation of section 86113 (3 counts). $1,000 fine. Campaign Contribution Limitation and Reporting Violation Don R. Perata and Don Perata 98, FPPC No. 2000/156. (Index No. 70419.) In August 1998, Don Perata of Alameda was a candidate in the special primary election for the State Senate, Ninth District. Perata received a $90,000 campaign loan from his father, Richard Perata. The respondents failed to properly itemize the source of this loan, in violation of Government Code section 84211, subdivision (f) (one count); and the loan exceeded the special election contribution limit by $89,000, in violation of Government Code section 85305, subdivision (c)(1) (one count). $4,000 fine. Campaign Reporting Violations California League of Conservation Voters and Fredric D. Woocher, FPPC No. 98/734. (Index No. 70416.) A Franchise Tax Board audit found that the California League of Conservation Voters of San Francisco, a sponsored general purpose committee, and the committee's treasurer, Fredric Woocher, failed to timely file late contribution reports, in violation of Government Code section 84203 (5 counts), failed to file independent expenditure reports, in violation of Government Code section 84203.5 (1 count), and failed to disclose and itemize contributions of $100 or more in a timely manner, in violation of Government Code section 84211, subdivision (f) (1 count). $14,000 fine. Richard L. Dickerson, Dickerson for Assembly and Mary J. Meisner, treasurer, FPPC No. 98/590. (Index No. 70418.) Richard L. Dickerson of Redding, Dickerson for Assembly and Mary J. Meisner failed to report subvendor information for one vendor over the course of five reporting periods, in violation of Government Code sections 84211, subdivision (j)(6) and 84303. $6,000 fine. Michela A. D. Alioto, Michela Alioto for California Secretary of State, and Linda T. Blum, FPPC No. 00/065. (Index No. 70420.) Michela A. D. Alioto of Novato, Michela Alioto for California Secretary of State, and Linda T. Blum failed to report subvendor information for expenditures made by the committee during 1998, in violation of Government Code section 84303 (1 count). $2,000 fine. Dennis Sammut and Artichoke Joe's, FPPC No. 00/362. (Index No.70411) Dennis Sammut of San Bruno and Artichoke Joe's failed to timely disclose eight contributions on their major donor report, in violation of Government Code section 84211 (1count). $1,000 fine. Mirage Resorts, Inc., FPPC No. 00/362. (Index No.70412) Mirage Resorts, Inc. of Las Vegas, Nev., failed to timely disclose seven contributions on its major donor report, in violation of Government Code section 84211 (1count). $1,000 fine. Carl Washington, Carl Washington for Assembly, and Pam Goodwin, treasurer, FPPC No. 00/362. (Index No70413) Carl Washington of Paramount, Carl Washington for Assembly and Pam Goodwin, treasurer, failed to timely disclose one contribution on the Committee's semi-annual campaign statement, in violation of Government Code section 84211 (1count). $1,000 fine. Oaks Card Club, FPPC No. 00/362. (Index No.70414.) Oaks Card Club of Emeryville failed to timely disclose two contributions on its major donor report, in violation of Government Code section 84211 (1count). $1,000 fine. Bay Meadows Operating Company, FPPC No. 00/362. (Index No.70407.) Bay Meadows Operating Company of San Mateo failed to timely file a major donor report, in violation of Government Code section 84200 (1 count). $2,000 fine. Lucky Chances Inc., FPPC No. 00/362. (Index No.70408) Lucky Chances, Inc. of Colma failed to timely file two major donor reports, in violation of Government Code section 84200 (2 counts) and failed to file a late contribution report, in violation of Government Code section 84203 (1 count). $3,500 fine. Dario Frommer, Dario Frommer for Assembly, and Stephen Kaufman, FPPC No. 00/345. (Index No.70409) Dario Frommer of Los Angeles, Dario Frommer for Assembly and Stephen Kaufman failed to file a late contribution report, in violation of Government Code section 84203 (1 count). $2,000 fine. Marvin Kay, FPPC No. 00/434. (Index No. 70410.) Marvin Kay of Los Angeles failed to timely file a major donor statement, in violation of Government Code section 84200 and failed to file a late contribution report, in violation of Government Code section 84203 (2 counts). $2,500 fine. Failure to Timely File Late Contribution Reports - Expedited Procedure Janice C. Leja, Leja for Assembly, and Doug Leja, Treasurer, FPPC No. 2000/348. (Index No. 70405.) Janice C. Leja, an Assembly candidate from Beaumont, Leja for Assembly and committee treasurer Doug Leja, failed to timely file a late contribution report, in violation of Government Code section 84203 (1 count). $2,000 fine. Failure to Timely File Statements of Economic Interests - Expedited Procedure Juan Sanchez, FPPC No. 2000/615. (Index No. 70415.) Juan Sanchez, a planning commissioner for the County of Monterey, failed to timely file his assuming office Statement of Economic Interests, in violation of Government Code section 87202 (1 count), and failed to timely file his 1999 annual Statement of Economic Interests, in violation of Government Code section 87203 (1 count). $600 fine. Failure to Timely File Major Donor Campaign Statement - Streamlined Procedure. The following persons and entities have entered into stipulations for failure to file a major donor campaign statement due during the calendar year of 2000, in violation of Government Code Section 84200: 1st Tier Violation - $400 fine Arrowhead General Insurance Agency, Inc., FPPC No. 2001-0008. (Index No. 74001.) Arrowhead General Insurance Agency, Inc. of San Diego made contributions totaling $10,000 (1 count). Lightspan, Inc., FPPC No. 2001-0026. (Index No. 74002.) Lightspan, Inc. of San Diego made contributions totaling $84,500, which included state and federal contributions, some made outside of California (1 count). Palos Verdes Portuguese Bend, LLC / Barry Hon Affiliates, FPPC No. 2001-031. (Index No. 74003.) Palos Verdes Portuguese Bend, LLC / Barry Hon Affiliates of Laguna Hills made contributions totaling $10,000 (1 count). Rancho Vista Development Company, FPPC No. 2001-0034. (Index No. 74004.) Rancho Vista Develepment Company of Palmdale made contributions totaling $16,550 (1 count). RBF Consulting, FPPC No. 2001-0035. (Index No. 74005.) RBF Consulting of Irvine made contributions totaling $50,889 (1 count). San Jose Water Company, FPPC No. 2001-0039. (Index No. 74006.) San Jose Water Company made contributions totaling $14,250 (1 count). Dennis Weinberg, FPPC No. 2001-0048. (Index No. 74007.) Dennis Weinberg of Camarillo made contributions totaling $53,900 (1 count). 2nd Tier Violation - $600 fine Thomas Anderson, FPPC No. 2001-0007. (Index No. 74008.) Thomas Anderson of Indio made contributions totaling $22,810 (1 count). Cohen Medical Group, FPPC No. 2001-0014. (Index No. 74009.) Cohen Medical Group of Long Beach made contributions totaling $60,500 (1 count). Raley's, FPPC No. 2001-0033. (Index No. 74010.) Raley's of Sacramento made contributions totaling $10,000 (1 count).
