Those who wish to comment on an item that has been listed on this agenda may comment when that item has been opened for consideration by the Commission and before any action is taken.

Behested Payments
4. In the Matter of Matt Mahan; FPPC No. 26/618. Staff: Kristin E. Goulet, Commission Counsel. Matt Mahan is represented by Gary Winuk of the Kaufman Legal Group. Mahan failed to timely file Form 803 behested payment reports regarding approximately 38 charitable payments of $5,000 or more totaling approximately $2,369,550, in violation of Government Code Sections 82004.5 and 84224 (16 counts). Total Proposed Penalty: $27,500.

5. Adoption of Proposed Amendments to Regulation 18723.1 to Clarify SEI Filing Requirements for Public Officials with Multiple Positions. Staff: Joanna Gin, Senior Commission Counsel. Staff proposes for adoption amendments to Regulation 18723.1 to clarify when Section 87200 and Code filers do not need to list Code-designated positions on their Expanded Statements of Economic Interests, allow “elected state officers” to only file a Statement of Economic Interests for their state elected office, and clarify filing requirements for Expanded Statements. Staff presented this proposal for pre-notice discussion in June and now presents it for adoption.
6. Prenotice Discussion of Proposed Amendments to Regulations in Response to Statutory Changes Pending New CAL-ACCESS Certification. Staff: Erika M. Boyd, Senior Commission Counsel, Legal Division. Staff proposes regulatory changes in response to Senate Bill 1239, Assembly Bill 909, and Assembly Bill 808, which amend various statutes following the implementation of the new CAL-ACCESS filing system, a new online system for submitting and viewing campaign finance and lobbying disclosure reports. The proposed regulatory changes are presented for discussion and direction by the Commission and will be presented for adoption at a subsequent meeting.

7. Updates to FPPC Campaign and Slate Mailer Organization Forms. Staff: Chloe Hackert, Education & External Affairs Unit Manager, Legal Division. Staff presents for Commission approval proposed changes to various campaign and slate mailer organization FPPC forms in response to the Secretary of State’s new CAL-ACCESS system set to take effect later this year.
