The following are enforcement decisions approved by the Fair Political Practices Commission at its regular monthly meeting held on Thursday, August 16, 2018. Decisions are listed by category and include a brief summary of each case and the total amount of any administrative fine in each case.

Additional information on each of the enforcement cases listed below can be found in the August agenda on the FPPC website at www.fppc.ca.gov. FPPC agendas are distributed and posted on the agency website at least 10 days prior to each monthly meeting.

Campaign Bank Account 

In the Matter of Alicia Cruz 4 School Board 2016 and Alicia Cruz; FPPC No. 17/620. Staff: Commission Counsel Theresa Gilbertson and Supervising Special Investigator Jay Martin. Alicia Cruz was a successful candidate for the Washington Unified School District Board of Education in the November 8, 2016 General Election. Alicia Cruz 4 School Board 2016 was her candidate-controlled committee. The Committee and Cruz failed to establish a dedicated campaign bank account to make all campaign expenditures from and deposit all contributions into, in violation of Government Code Section 85201 (1 count). The Committee also failed to timely file one pre-election and one semiannual campaign statement covering the reporting periods of January 1, 2016 through December 31, 2016, in violation of Government Code Sections 84200, 84200.5, and 84200.8 (1 count). Fine: $3,500. 

Cash Contribution 

In the Matter of Quality Education in Support of Recall Lorona, Orosco, Lopez; Sara Rodriguez; Harpreet Purewal; Frank Hoyt; and John Hoyt; FPPC No. 16/414. Staff: Commission Counsel Ruth Yang and Special Investigator Marshall Miller. Quality Education in Support of Recall Lorona, Orosco, Lopez was a committee primarily formed to support a recall of three Selma Unified School District Board members on the November 3, 2015 General Election ballot in Fresno County. Sara Rodriguez was the Committee’s treasurer. Harpreet Purewal, Frank Hoyt, and John Hoyt were the Committee’s principal officers. The Committee, Rodriguez, Purewal, and the Hoyts accepted cash contributions of $100 or more, in violation of Government Code Section 84300 (1 count); and failed to timely disclose the receipt of nonmonetary contributions, in violation of Government Code Section 84211 (1 count). Fine: $4,000. 

Advertisements 

In the Matter of Yes on Prop. 57, Californians and Governor Brown for Public Safety and Rehabilitation; FPPC No. 16/19684. Staff: Commission Counsel Christopher Burton. The respondents are represented by James C. Harrison of Remcho, Johansen & Purcell, LLP. Yes on Prop. 57, Californians and Governor Brown for Public Safety and Rehabilitation was a primarily formed ballot measure committee created to support California Proposition 57 on the November 8, 2016 General Election ballot. The Committee failed to identify the California Democratic Party as one of its top two contributors of $50,000 or more, and failed to present the text in a clear and conspicuous manner in an advertisement disclosure statement on its website, in violation of Government Code Section 84503 and Regulation 18450.4, subdivisions (b)(1) and (b)(3)(G)(1) (1 count). Fine: $2,500. 

Lobbying Reporting 

In the Matter of Los Angeles County Metropolitan Transportation Authority; FPPC No. 16/469. Staff: Commission Counsel Ruth Yang. The respondent was represented by Assistant County Counsel Charles Safer. The Los Angeles County Metropolitan Transportation Authority (“LA Metro”) is a public transportation agency for the County of Los Angeles. LA Metro failed to accurately report the payments made to lobbying firms, in violation of Government Code Section 86116, subdivision (b), (1 count); and failed to timely disclose other payments to influence, in violation of Government Code Section 86116, subdivision (h)(1) and 86117 (1 count). Fine: $3,500. 

Mass Mailing at Public Expense 

In the Matter of Riverside County Office of Education; FPPC No. 18/101. Staff: Commission Counsel Ruth Yang and Special Investigator Garrett Micheels. The respondents are represented by John W. Dietrich of Atkinson, Andelson, Loya, Ruud and Romo. In or around January 2018, the Riverside County Office of Education designed, printed, and distributed over 200 copies of a booklet at public expense featuring photographs and names of several elected officials, in violation of Government Code Sections 89001 and 89002, subdivision (a) (1 count). Fine: $2,000. 

Campaign Reporting 

In the Matter of Privacy for All Students, Karen England, and John Fugatt; FPPC No. 14/1111. Staff: Commission Counsel Christopher Burton. Privacy for All Students is a primarily formed ballot measure committee created to support several attempts to qualify a ballot measure that would undo Assembly Bill 1266, which permits student participation based on gender identity. John Fugatt is the Committee’s treasurer. Karen England is the Committee’s principal officer. The Committee, England, and Fugatt failed to timely file four semiannual campaign statements covering the reporting periods of October 1, 2013 through December 31, 2013, July 1, 2014 through December 31, 2015, and January 1, 2016 through December 31, 2016, in violation of Government Code Section 84200, subdivision (a) (1 count); and failed to timely report contributions on a quarterly campaign statement; contributions, expenditures, and a miscellaneous increase to cash on a semiannual campaign statement; and contributions on a semiannual campaign statement, in violation of Section 84211, subdivisions (a), (b), (c), (f), (i), (k), and (l) (1 count). Fine: $6,500. 

In the Matter of Associated Builders and Contractors Central California Chapter PAC (ABC – PAC) and Laura Barnes; FPPC No. 18/146 (Streamline Settlement). Staff: Chief of Enforcement Galena West and Staff Services Analyst Hayley Porter. Associated Builders and Contractors Central California Chapter PAC (ABC – PAC) was a local general purpose committee. Laura Barnes was the Committee’s treasurer. The Committee and Barnes failed to timely report one contribution on a pre-election campaign statement, in violation of Government Code Section 84211 (1 count); and failed to timely file twelve 24-Hour Reports, in violation of Government Code Section 84203 (12 counts). Fine: $3,053. 

Campaign Non-Filer 

In the Matter of California Conservative PAC and John Fugatt; FPPC No. 15/1301. Staff: Senior Commission Counsel Bridgette Castillo, Special Investigator Paul Rasey and Associate Governmental Program Analyst Dominika Wojenska. The California Conservative PAC is a state general purpose committee. John Fugatt is the Committee’s treasurer and principal officer. The Committee and Fugatt failed to timely and properly file: two semiannual campaign statements for the reporting periods of July 1, 2013 through June 30, 2014, in violation of Government Code Sections 84200, 84605 and 84211 subdivisions (a)-(d) (1 count); one pre-election campaign statement for the reporting period of July 1, 2014 through October 18, 2014, in violation of Government Code Sections 84200.5, 84200.7 and 84605 (1 count); and two semiannual campaign statements for the reporting periods of October 19, 2014 through June 30, 2015, in violation of Government Code Sections 84200 and 84605 (1 count). Fine: $7,500.

In the Matter of Lewis for Water Board 2013 and Brenda Lewis; FPPC No. 16/322 (Streamline Settlement). Staff: Commission Counsel Theresa Gilbertson and Associate Governmental Program Analyst Dominika Wojenska. Brenda Lewis was the successful candidate for the Monterey Peninsula Water Management District Board of Directors in the November 5, 2013 General Election. Lewis for Water Board 2013 was her candidate-controlled committee. The Committee and Lewis failed to timely file seven semiannual campaign statements for the reporting period of October 21, 2013 through December 31, 2016, in violation of Government Code Section 84200 (7 counts). Fine: $5,621.  

In the Matter of Stanislaus County Democratic Central Committee – State and Rita Copeland; FPPC No. 17/617. Staff: Commission Counsel Michael W. Hamilton and Program Specialist Grant Beauchamp. The Stanislaus Democratic Central Committee is local general purpose committee. Rita Copeland is the Committee’s treasurer. The Committee and Copeland failed to timely file two pre-election campaign statements for the reporting period of March 31, 2013 through June 8, 2013 and October 19, 2014 through October 25, 2014, in violation of Government Code Sections 84200.5 and 84200.8 (1 count); and one 24-Hour Report, in violation of Government Code Section 84203 (1 count). Fine: $3,500. 

In the Matter of Ramirez for Senate 2013, Francisco Ramirez for Hanford City Council 2014, and Francisco Ramirez; FPPC No. 15/1277 (Streamline Settlement). Staff: Commission Counsel Michael W. Hamilton and Special Investigator Ann Flaherty. Francisco Ramirez was an unsuccessful candidate for State Senate District 16 in the May 21, 2013 Primary Election and a successful candidate for Hanford City Council in the November 4, 2014 General Election. Ramirez for Senate 2013 was the candidate-controlled committee in the 2013 Primary Election. The Senate Committee and Ramirez failed to timely file one semiannual campaign statement covering the reporting period of May 5, 2013 through June 30, 2013, in violation of Government Code Section 84200 (1 count). Francisco Ramirez for Hanford City Council 2014 was the candidate-controlled committee in the 2014 General Election. The City Council Committee and Ramirez failed to timely file a Statement of Organization, in violation of Government Code Section 84101 (1 count); two pre-election campaign statements covering the reporting periods of January 1, 2014 through October 18, 2014, in violation of Government Code Sections 84200.5 and 84200.7 (2 counts); and one semiannual campaign statement covering the reporting period of October 19, 2014 through December 31, 2014, in violation of Government Code Section 84200 (1 count). Fine:  $1,075. 

In the Matter of Committee to Elect Two New Council Members and John Wolf; FPPC No. 15/2061 (Streamline Settlement). Staff: Commission Counsel Michael W. Hamilton and Special Investigator George Aradi. The Respondents are represented by Cary Davidson of Reed & Davidson LLP. Committee to Elect Two New Council Members was a primarily formed Committee to support two candidates, Eugene Sun and Dennis Kneier, for San Marino City Council in the November 5, 2015 General Election. John Wolf was the Committee’s treasurer. The Committee and Wolf failed to timely file a pre-election campaign statement for reporting period of January 1, 2015 through October 17, 2015, in violation of Government Code Sections 84200.5 and 84200.8 (1 count); and one 24-Hour Report, in violation of Government Code Section 84203 (1 count) Fine:  $446. 

In the Matter of Committee to Elect Brett Frazier for Supervisor 2018, Brett F. Frazier, and Janet Bitter; FPPC No. 18/389 (Streamline Settlement). Staff: Chief of Enforcement Galena West and Political Reform Consultant Chris Holm. Brett Frazier was a successful candidate for Supervisor of Madera County in the June 5, 2018 Primary Election. Committee to Elect Brett Frazier for Supervisor 2018 is his candidate-controlled committee. Janet Bitter was the Committee’s treasurer. The Committee, Frazier, and Bitter failed to timely file one pre-election campaign statement for the reporting period of January 1, 2018 through April 21, 2018, in violation of Government Code Section 84200.5 (1 count). In the Matter of Committee to Elect David Dodson to Board of Equalization Fourth District 2018 and David Dodson; FPPC No. 18/580 (Streamline Settlement). Matt Darby was an unsuccessful candidate for Tulare County District Attorney in the June 5, 2018 Primary Election. Darby for District Attorney 2018 was his candidate-controlled committee. Vernon McDonald was the Committee’s treasurer. The Committee, Darby, and McDonald failed to properly report the occupation and employer information for contributions received on a pre-election campaign statement, in violation of Government Code Section 84211 (1 count). Fine: $351.  

In the Matter of Committee to Recall San Marino Councilman Kneier and John Wolf; FPPC No 18/584 (Streamline Settlement). Staff:  Commission Counsel Michael W.
