1. Public Comment for Items not on Agenda. During this comment period, any person is invited to speak on any topic that is not listed on this agenda. Action may not be taken on any matter raised during this public comment period until the matter is specifically listed on a future agenda. Those who wish to comment on an item that has been listed on this agenda may comment when that item has been opened for consideration by the Commission and before any action is taken.

The Commission should avoid discussing and may not act on any matter raised during this public comment period, except to decide whether to place the matter on the agenda of a future meeting during the last item on the agenda.

3. In the Matter of Michael Gatto and Joshua Meister; FPPC Case No. 20/945. Staff: Neal Bucknell, Senior Commission Counsel and Kristin Hamilton, Special Investigator. Respondent Meister is represented by Richard Davis of Bowse Davis Huffine Chung & Hull LLP. In this matter, Gatto and Meister formed an independent expenditure committee, but failed to timely file a 24-Hour Report and a semiannual statement, in violation of Government Code Sections 84200 and 84204 (1 count). Gatto and Meister failed to include proper advertisement disclosure on a mailer, in violation of Government Code Sections 84502, 84504.2, and 84506.5 (1 count). Total Proposed Penalty: $7,500.

4. In the Matter of Stephanie Nguyen for Assembly 2022 and Stephanie Nguyen; FPPC No. 22/443. Staff: Vanessa Jimmy, Commission Counsel and Alethea Perez, Special Investigator. The Respondent is represented by Gary S. Winuk of Kaufman Legal Group, APC. Stephanie Nguyen was a successful candidate for State Assembly, District 10, in the June 7, 2022 Primary Election. Stephanie Nguyen for Assembly 2022 was Nguyen’s candidate-controlled committee. Nguyen served as the Committee’s treasurer. The Committee and Nguyen failed to include the proper advertisement disclosures in a mailer, in violation of Government Code Section 84305 (1 count). Total Proposed Penalty: $4,000.

5. CAL-ACCESS Replacement System (CARS). Denise Tower, CGI Project Manager, John Heinlein, SOS Assistant Project Director, and Laura Shultz, SOS Assistant Division Chief, Political Reform Division. The Secretary of State will demonstrate functionality to gain access to the system, how to perform initial filer actions, and ways to search for publicly available information.

6. CAL-ACCESS Outputs. Staff: Chloe Hackert, Education & External Affairs Unit Manager, Legal Division. Staff will present for Commission consideration samples of outputs designed by the Office of the Secretary of State (SOS) that will be generated by SOS’s new CAL-ACCESS system. The outputs display data entered into CAL-ACCESS by filers and will serve as an alternative to the current forms.

7. Assignment of Hearing to Administrative Law Judge (ALJ): In the Matter of Debbie Moser, FPPC No. 24-946.Staff: Executive Director Galena West, Chief of Enforcement Kendall L.D. Bonebrake, and Commission Counsel Kristin E. Goulet. The Executive Director and the Chief of Enforcement are recommending that a hearing be conducted before an ALJ pursuant to Government Code Section 11512, subdivision (a). The ALJ will make a recommendation to the Commission on the findings of fact, law and penalty, if applicable, in the matter. The Commission will then have the opportunity to review the proposed decision and make the final determination on the case. If the Commission agrees with this recommendation, no action is required.

8. Legislative Update. Staff: Lindsey Nakano, Senior FPPC Legislative Counsel. The Commission will review and discuss potential sponsored and other legislation. The Commission may provide direction to staff regarding the same.
