Proposal to Amend Conflict of Interest Regulation 18705.1-Business Entity Materiality
Staff of the Fair Political Practices Commission will be holding an interested persons meeting to solicit public input relating to amending the Political Reform Act’s (the “Act”), conflict of interest regulation specifying what constitutes a “material financial effect” on a public official’s financial interest in a business entity. (See Section 87103 and Regulation 18705.1.)
In a continuing effort to clarify and simplify regulations pertaining to the implementation of the Act, staff is soliciting input to improve the conflict of interest regulations. Recently staff has proposed regulations modifying what is a material financial effect on a real property interest as the first step in improving the materiality standards applicable under the Act provisions. The next step in the process is to examine improving the application of standards used to determine when a financial effect is material with respect to an official’s interest in a business entity. This meeting is for the purpose of seeking public input to draft improvement that will enhance the understanding and application of this regulation.
Proposed language for amended Regulation 18705.1 can be reviewed at http://www.fppc.ca.gov/index.php?id=247#2. Staff intends to present suggested language to the Commission at the November 20, 2014 Commission meeting.
