According to (Gov. Code Section 11123) (a) all meetings of a state body shall be open and public and all persons shall be permitted to attend any meeting of a state body except as otherwise provided in this article. The Section further states: the portion of the teleconferenced meeting that is required to be open to the public shall be audible to the public at the location specified in the notice of the meeting.

As stated above, the meeting of the Commission will take place at the City of Oakland Public Ethics Commission, 1 Frank H. Ogawa Plaza, 11th Floor Oakland, CA 94612. However, the following members will attend via teleconference: Vice Chair Eskovitz will participate from 355 South Grand Avenue, Los Angeles, CA 9007; Commissioner Wynne will participate from the Santa Cruz County Administrative Office, 701 Ocean Street, Room 520, Santa Cruz, CA 95060; Commissioner Wasserman will attend from 505 N Michigan Avenue, Chicago, IL 60611.

Members of the public can appear at any listed teleconference locations. Agendas will be posted at the teleconference location and the teleconference location will conduct the meetings in a manner that protects the rights of any party or member of the public appearing before the state body (Commission).

1. Call to order and establishment of quorum - Open Session

2. Public Comment

This portion of the meeting is reserved for comment on items not on the agenda. Under the Bagley-Keene Act, the Commission cannot act on items raised during public comment, but may respond briefly to statements made or questions posed; request clarification; or refer the item to staff.

3. Finding pursuant to Government Code section 11125.4(c) relative to holding special meeting on less than 10 days notice

This meeting has been called and noticed pursuant to the special meeting provision of the Bagley-Keene Open Meeting Act, which allows for a meeting on less than 10 days notice under certain circumstances, including consideration of pending litigation and consideration of issuance of a legal opinion. Based on the immediate need for the Commission to discuss pending litigation and the issuance of a legal opinion, the Commission finds that it would create a substantial hardship to delay this meeting, and so has properly called and noticed this special meeting pursuant to applicable law.

Pending Litigation (Gov. Code §11126(e)(1)). Deliberation upon:

Administrative Hearing: In the Matter of Bill Berryhill, Tom Berryhill, Bill Berryhill For Assembly - 2008, Berryhill For Assembly 2008, Stanislaus Republican Central Committee (State Acct.), and San Joaquin County Republican Central Committee/Calif. Republican Victory Fund (FPPC No. 10/828).
