1. Public Comment for Items not on Agenda. During this comment period, any person is invited to speak on any topic that is not listed on this agenda. Action may not be taken on any matter raised during this public comment period until the matter is specifically listed on a future agenda. Those who wish to comment on an item that has been listed on this agenda may comment when that item has been opened for consideration by the Commission and before any action is taken.

The Commission should avoid discussing and may not act on any matter raised during this public comment period, except to decide whether to place the matter on the agenda of a future meeting during the last item on the agenda.

3. In the Matter of Miguel Pulido; FPPC No. 19/531. Staff: Neal Bucknell, Senior Commission Counsel and Paul Rasey, Special Investigator. Miguel Pulido was the Mayor of Santa Ana. Pulido received personal loans, which were not in writing, from three different lenders, in violation of Section 87461 (2 counts). Total Proposed Penalty: $6,500.

Mass Mailings at Public Expense

4. In the Matter of County of San Benito; FPPC No. 23/006. Staff: Alex Rose, Senior Commission Counsel and Kristin Hamilton, Special Investigator. The County of San Benito is represented by Gregory Priamos of Prentice | Long, PC. The County of San Benito sent prohibited campaign-related mass mailings at public expense, in violation of Government Code Section 89001 and Regulation 18901.1 (1 count), failed to include the proper advertising disclosure on mailers, in violation of Government Code Sections 84502 and 84504.2 (1 count), failed to timely file a semi-annual campaign statement, in violation of Government Code Section 84200, subdivision (b) (1 count), and failed to timely file one 24-Hour Report, in violation of Government Code Section 84204 (1 count). Total Proposed Penalty: $18,000.

5. In the Matter of Oceanside Unified School District; FPPC No. 24/1211. Staff: Alex Rose, Senior Commission Counsel and Victoria Cichy, Special Investigator. Oceanside Unified School District (“OUSD”) is represented by Jonathan Salt of F3 Law. OUSD is a public school district based in San Diego County. OUSD sent a two-sided newsletter to every resident of Oceanside that featured each of the eight OUSD Board of Trustees members. Thus, OUSD sent a prohibited mass mailing at public expense, in violation of Government Code Sections 89001 and 89002 (1 count). Total Proposed Penalty: $4,000.

6-7. Pre-Notice Default

6. In the Matter of Committee to Elect Stevevonna Evans 2018 Adelanto City Council, Stevevonna Evans for Board of Supervisors 2020, and Stevevonna Evans; FPPC No. 20/1097. Staff: Marissa Corona, Senior Commission Counsel and Jay Gehres, Special Investigator. Stevevonna Evans for Board of Supervisors 2020 and Stevevonna Evans were the subject of an audit performed by the Audit Division of the Fair Political Practices Commission. Stevevonna Evans was a successful candidate for Adelanto City Council in the November 6, 2018 General Election, an unsuccessful candidate for San Bernardino County Board of Supervisor in the March 3, 2020 Primary Election, an unsuccessful candidate for Mayor of Adelanto in the November 8, 2022 General Election, a successful candidate for Adelanto City Council in the November 5, 2024 General Election, and is currently in office as a member of the Adelanto City Council. Committee to Elect Stevevonna Evans 2018 Adelanto City Council (the “2018 Committee”) was Evans’ candidate-controlled committee during the November 6, 2018 General Election and Stevevonna Evans for Board of Supervisors 2020 (the “2020 Committee”) was Evan’s candidate-controlled committee during the March 3, 2020 Primary Election. Evans did not establish a candidate-controlled committee for the November 8, 2022, and November 5, 2024 General Elections. The 2018 Committee and Evans failed to timely file ten semi-annual campaign statements, in violation of Government Code Section 84200 (4 counts), and six pre-election campaign statements, in violation of Government Code Section 84200.5 (6 counts). The 2020 Committee and Evans failed to timely file one 24-Hour Report, in violation of Government Code Section 84203 (1 count), ten semi-annual campaign statements, in violation of Government Code Section 84200 (4 counts), and six pre-election campaign statements, in violation of Government Code Section 84200.5 (6 counts). Additionally, the 2020 Committee failed to maintain detailed campaign records for contributions received and expenditures made, in violation of Government Code Section 84101 (2 counts). Finally, Evans, as a candidate in the November 8, 2022, and November 5, 2024 General Elections, failed to timely file four pre-election campaign statements, in violation of Government Code Section 84200.5 (4 counts). Total Proposed Penalty: $76,500.
 

7. In the Matter of Steven Sanchez; FPPC No. 22/887. Staff: Angela J. Brereton, Assistant Chief of Enforcement and Shaina Elkin, Associate Governmental Program Analyst. Steven Sanchez was a successful candidate for the Franklin-McKinley Elementary School Board in the November 8, 2022 General Election. Sanchez failed to timely file a pre-election campaign statement, in violation of Government Code Sections 84200.5 and 84200.8 (1 count) and four semi-annual campaign statements, in violation of Government Code Section 84200 (4 counts). Total Proposed Penalty: $9,500.

8. Adoption of the 2025/2026 Statement of Economic Interests, Form 700. Staff: Chloe Hackert, Manager, Education and External Affairs Unit, Legal Division. Forms and related documents have been revised to reflect relevant dates, filing deadlines, and resulting changes from the passage of recent legislation. The Commission will consider the revised forms for adoption.

9. Adoption of Updated Form 463, Report of Security Expenses. Staff: Chloe Hackert, Manager, Education & External Affairs Unit, Legal Division. Staff presents updated Form 463 as a result of recent legislation. The Commission will consider the updated form for adoption.

10. Adoption of Proposed Regulation 18430.1 and Amendments to Regulation 18421.3 and 18401, Limitations on Prepaid Cards and Recordkeeping Requirements for Contract Vendors. Staff: Zachary Norton, Senior Commission Counsel. Staff proposes adoption of Regulation 18430.1 to add prohibitions and limitations on contributions and expenditures using prepaid cards, as well as amendments to Regulation 18421.3 to prohibit candidates or committees from contracting with payment processors that do not utilize more stringent verification measures and Regulation 18401 to add additional recordkeeping requirements relating to contributions received through payment processors. Staff presented this proposal for pre-notice discussion in June and presented it for adoption in August. In response to public comment, and at the Commission’s direction, this proposal now includes an exception to the prohibition in Regulation 18430.1 on expenditures made with prepaid cards, to permit the use of prepaid cards linked to a prepaid expense account and management system that maintains detailed, itemized records of all expenditures. Staff now presents it for adoption.

11. Presentation of New FPPC Logo. Staff: Kevin Cornwall, Senior Commission Counsel. Staff presents the new FPPC logo redesigned, in part, to ensure adherence to ADA requirements. 

 

12. The FPPC Streamline Program: How It Works (Part 3). Staff: Marissa Corona, Senior Commission Counsel, Enforcement Division and Chance Felkins, Commission Counsel, Enforcement Division. Eligibility factors for campaign related violations and ethics and lobbying related violations in the FPPC’s Streamline Program, including information on the violation types, notable criteria, and hypotheticals.
